1. The Service

LandMonitor provides public lands transparency tools, including monitoring of publicly broadcast ranger radio communications for the Midpeninsula Regional Open Space District (MROSD), trail condition alerts, and public records request tracking. The radio communications we monitor are broadcast on public, unencrypted frequencies and are not private communications.

2. Accounts

To use certain features (such as alerts), you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose
• Interfere with or disrupt the Site or its infrastructure
• Attempt to gain unauthorized access to any part of the Site
• Scrape, crawl, or use automated means to access the Site without permission
• Use information from the Site to harass, stalk, or harm any individual, including public employees

4. Intellectual Property

The Site and its original content, features, and functionality are owned by us and are protected by applicable copyright, trademark, and other intellectual property laws. Radio transcripts are derived from public broadcasts and are provided for informational purposes only.

5. Disclaimer of Warranties

The Site is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free. Radio transcripts are generated by automated speech recognition and may contain errors. Do not rely on transcript content for safety-critical decisions.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site. Our total liability shall not exceed fifty US dollars ($50).

7. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

8. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Upon termination, your right to use the Site ceases immediately.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

10. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
